Terms and Conditions
Orders and Refunds
These general terms and conditions shall apply to all orders of equipment (accessories and consumables included) and /or services, whose references and prices are listed on the web site www.educationresearch.com.au
On placing such orders, the customer agrees to comply fully and without exception to these general terms and conditions of sale.
Orders
Orders must be placed with Education Research Solutions either directly on the web site www.,educationresearch.com.au or by letter, fax, e-mail or telephone.
Orders must include the following information :
Education Research Solutions reserves the right to refuse any order placed by a customer where there has been any dispute relating to the payment of a previous order.
Delivery
The delivery periods stated on the web site www.educationresearch.com.au are standard delivery periods given on a purely indicative basis. They shall start :
The maximum delivery period is 7 (7) days. If the equipment has not been delivered within seven (7) days after the expiry of this delivery period, the consumer is entitled to cancel his/her order without incurring any charge, by sending a notice of cancellation. This must be sent no later than sixty (60) days from the expiry of the delivery period. In such cases the sums already paid by the customer for his /her order shall be refunded, but the customer shall not be entitled to claim any liquidated damages and/or damages from Education Research Solutions.
Installation - Use of equipment
The customer is responsible for the installation of the equipment in accordance with the instruction manual provided .
It will be the customer’s responsibility to arrange for connection of the equipment to any network. The customer undertakes to use the programs in accordance with the instruction manual and not to copy or disclose to any third party, any knowledge, experience or documentation acquired from Education Research Solutions or any software or software packages installed in the equipment. The customer also undertakes to respect and ensure that users respect the corresponding software licence agreements.
Price - Payment
The prices listed on the web site www.educationresearch.com.au may be changed by Education Research Solutions at any time and without notice.
The customer shall pay, without any deduction whatsoever, the total order price. The total price of the order means the price of the equipment and / or service ordered plus delivery and packing charges, as these prices and charges are indicated on the web site www.educationresearch.com.au at the date of the order.
Payment shall be effected to Education Research Solutions in Australian Dollars , either by cheque, credit card, or by bank transfer,
All charges and taxes incurred as a result of use of the equipment (in particular subscription and use charges) shall be borne exclusively by the customer.
In the case of non payment of any amount invoiced by the due date, and without prejudice to the cancellation of the order, interest will be payable at a rate equal to one and a half (1.5) times the legal interest rate in force, starting from the day after the payment due date, as specified on the invoice, until payment is effected; interest shall be payable upon receipt of the debit note sent by Education Research Solutions.
Reservation of Title
THE EQUIPMENT SHALL REMAIN THE ENTIRE AND EXCLUSIVE PROPERTY OF Education Research Solutions UNTIL PAYMENT OF THE TOTAL PRICE DUE HAS BEEN RECEIVED.
All intellectual and industrial property rights in the equipment supplied by Education Research Solutions shall at all times remain vested in Education Research Solutions absolutely.
Termination
If the customer is in breach of any of his/her contractual obligations and if such breach remains unremedied for a period of fifteen (15) days following notice given by Education Research Solutions shall be entitled to terminate the order as of right and without the need for any application to the courts. In such a case, the customer will immediately return the products.
Refund - exchange
The customer – if dealing as a consumer – is entitled within fifteen (15) days of the date of delivery of the equipment, to a refund of, or to exchange the equipment for a different product, subject to the return of the product to Education Research Solutions in its original condition and packaging, together with the invoice. Such refund or exchange will be made only on condition that the equipment has not been tailor-made to the consumer’s specifications or is not clearly personalised. In respect of software, the consumer shall not be entitled to a refund or exchange within such fifteen (15) day period if he/she has unsealed the software. All costs and risks of returning the equipment shall be borne by the customer. Returns with postage due will be refused.
The right to exchange or to obtain a refund also applies to services ordered by consumers, provided that those services have not already been provided to the consumer, with his/her consent, within the above-stated 15 day period..
Returns shall be sent to Education Research Solutions to the address specified on the delivery note.
Equipment that is returned either incomplete or damaged, or without its packaging and / or without its invoice, will be neither exchanged nor refunded by Education Research Solutions.
Refunds will be effected by bank transfer within thirty (30) days of receipt of the equipment by Education Research Solutions.
Technical specifications
The technical specifications of the equipment as indicated on the web site www.educationresearch.com.au are given on a purely indicative basis. Education Research Solutions reserves the right to make modifications to these specifications, in line with technical advances, even after receipt of the order, as long as these modifications do not affect the essential features of the program, and the features which the customer has expressly ordered. In no case shall such modification result in a price increase or affect the quality of the equipment.
Data Protection
In accordance with the provisions of the law customers are entitled to access and rectify any data relating to them.
Customers may receive offers from Education Research Solutions relating to Education Research Solutions products, by mail, e mail, fax or phone.
If customers do not wish to receive offers from Education Research Solutions or if they wish to exert their right of access and rectification, they should inform Education Research Solutions by sending notice to the following address :
