Terms and Conditions
 
School Site Licence: The following agreement entitles the school to a School Site Licence for the use of the Curriculum Organiser for the life of the school.
 
Agreement parties: The agreement is between Education Research Solutions Pty Ltd and the Principal of the school and all subsequent Principals of the School.

Responsibilities of Education Research Solutions: Education Research Solutions agrees to provide the following upon purchase of products
 
Curriculum materials

Membership for use of the Curriculum Organiser as defined below:

  • Access to the designated software program described in the products list
  • Provision of a school serial number (16 digits) to allow installation of the software onto teacher’s school and personal computers/laptops.
  • Written instructions for installation and use of software.
  • Written guidelines for use of printed materials.
  • Entitlement to create a shared school drive for coordinated, collaborative, cumulative curriculum.
  • Email support to assist teacher planning.
  • Website support including 'Frequently Asked Questions'.
Technical support: Education Research Solutions provides technical support for the installation and use of the Curriculum Organiser for a period of one year from the date of purchase.
  • Technical support is to be by telephone, email,
  • School visits will be provided under certain conditions, negotiated between the parties.
  • Education Research Solutions is not responsible for solving technical problems that involve software that is not related to the Curriculum Organiser software.
  • Subsequent support can be provided at commercial rates.

Duration of the School Site Licence Agreement: Education Research Solutions agrees to permit the use of the Curriculum Organiser by all teachers covered by the Site Licence within the school including:

  • The current number of teachers located at the school 
  • Replacement teachers subsequently appointed to the school,

Note: It is necessary for schools to purchase additional licences if teacher numbers are increased.

The Site Licence remains in operation for the life of the school, while all conditions of the Site Licence continue to be met. Breaches of the School Site Licence Agreement will result in loss of right to use the Curriculum Organiser.
 
Updates: Education Research Solutions agrees to provide curriculum updates for programs in both CDROM and on-line services. Updates will be available annually at the cost of $55 / teacher. Schools that have an existing Site Licence will be able to purchase these updates.
 
RESPONSIBILITIES OF THE SCHOOL PRINCIPAL
 
Obtain a School Site Licence: A 'School Site Licence' is granted when the principal agrees to pay the fees listed in the attached invoice.
 
Permitted use of the Curriculum Organiser: The school is permitted to use the Curriculum Organiser in the following ways:
  • Copying of any document within the Curriculum Organiser either mechanically or electronically for use by its teachers.
  • Creation and sharing of new documents using the formats provided by the Curriculum Organiser with other teachers:
  • Within the school, or
  • With other teachers with ‘Individual Licences’, or
  • With other schools that have purchased a School Site Licence.
Prohibited use of the Curriculum Organiser
  • However, under copyright laws, and the above agreement, the school, and its teachers are not permitted to copy, transfer or share the materials or formats with teachers from other schools that have not purchased either a 'School Site Licence' or an 'Individual Licence'. 
  • Teachers are not permitted to use the Curriculum Organiser if they transfer to a school without a 'School Site Licence' or without an ‘Individual Licence’. If a teacher transfers to another school they may purchase an 'Individual Licence' for their personal use only in the new school.
  • Schools are prohibited from on-selling the Curriculum Organiser program to other schools.
Installation
  • On purchasing a School Site Licence, the principal may enable current teachers to install the software on personal school computers, home computers and on all school-based computers.
  • The principal will provide teachers with a serial number (16 digits) obtained from Education Research Solutions to allow installation onto teacher’s computers. This serial number is to be kept secure.
  • If a teacher loses the electronic version of the Curriculum Organiser, the principal can provide them with another copy for re-installation. The principal is permitted to re-issue the serial number.
Duration: The school has a lifetime licence to issue materials and software to incoming teachers while all conditions above continue to be met. The licence is terminated by Education Research Solutions if there is a serious breach of the 'Protection of Intellectual Property' conditions defined above.
 
Supervision of teachers leaving the school: If a teacher leaves the school, the teacher is to return the program and uninstall the software from personal computers. Teachers are to sign a letter stating that the program has been uninstalled. A copy of the letter is provided. The signed letters are to be kept on file in the school.
 
Ownership of material: Materials purchased under the 'School Site Licence' remain the property of the school.
 
Professional development Services: The principal may engage Education Research Solutions to undertake professional development.
 
DEFINITION OF TERMS
Definition: Curriculum Organiser
The Curriculum Organiser includes all of the following components:
 
A.  Paper documents provided within a file with plastic sleeves comprising:
  • Progress Maps
  • Scope and Sequence Charts
  • Teacher Planning documents within a specially designed format: Overarching Learning Outcomes, Progress Maps, Learning Area Outcomes, Processes, Concepts, Values, Contexts, Knowledge, Skills, Dynamic Strategies, Assessments, Links, Resources.
  • Integrated Units
  • Graphic Organisers
  • Planning proformas
  • Student Assessment records
B.  The software version comprises all documents listed above in electronic format.
 
C.  Software that provides: electronic access, storage, transfer and editing functions. Web browser interface.
 
D.  Instructions on: Installation of the software onto individual teacher’s computers. Planning procedures for use of files and electronic processes. 
 
Definition: School Site Licence
A ‘School Site Licence’ is granted when there is agreement between the principal and Education Research Solutions. The School Site Licence:
  • Permits teachers within the school to use the Curriculum Organiser.  
  • Applies to teachers and the principal currently employed at the school.
  • Is not transferred with the individual teacher or principal upon leaving the school.
Definition: Principal  
Reference to the 'principal' refers to the position of school leader representing the school who has the responsibility for legal agreements made by the school. Thus, the term is generic and includes the current principal and future principals at the school.
 
Definition: Use of the Curriculum Organiser
The term 'use' of the Curriculum Organiser, refers to:
  • Copying: either mechanically to produce paper copies or any form of electronic production using CD, disks, email or internet.
  • Creating: new documents using the Curriculum Organiser formats or intellectual property, produced either mechanically or electronically.
  • Sharing: any document derived from the Curriculum Organiser and transferred to another person either mechanically or electronically.
Protection of Intellectual Property
The intellectual property rights related to the ‘Curriculum Organiser’ documents are protected by:
  • School Site Licence number. A number dedicated to the particular school that is placed on various documents within the Curriculum Organiser. 
  • Copyright symbol  © - an internationally recognised symbol that prevents copying in any form.
  • ‘The Curriculum Organiser’ logo/trademark (pending).
  • The software is also protected by a dedicated 'School Serial Number comprising 16 digits
  • Agreement at the point of installation of the software.
  • Teachers leaving the school sign a declaration that materials are retained in the school.
  • School Principal Agreement.
